2023 SWEEPSTAKES ELIGIBILITY, RULES & REGULATIONS

  1. OVERVIEW

aDiamondMortgage (“Sponsor”) is offering a Sweepstakes called One Winner Per Week For 12 Weeks, (The Sweepstakes). One lucky winner could win the grand prize(s) of up to $1,500.00, Hotel Stay Voucher (HSV). NO PURCHASE NECESSARY!

  1. CONDIT IONS OF ELIGIBILITY

The Sweepstakes is open to lawful residents of Alberta, Canada who have reached the age of majority.  in the province of residence. Officers, directors, representatives and employees of aDiamondMortgage (“Sponsors”), their respective parents, affiliates brokers, franchisees, or subsidiaries, their advertising, promotional, publicity, production, or judging agencies, and all those living in the same households are ineligible to enter.

  1. The Sweepstakes PERIOD

The Sweepstakes commences October 01, 2023 at different locations and closes after 12 weeks per location. Different locations can have different start dates and every location will last for 12 weeks. Each individual location will close after 12 weeks.

  1. HOW TO ENTER APPLICATIONS

Enter the Sweepstakes by using the QR Code and filling out the information on the entry form.

  1. THE PRIZE

Grand Prize: There is one grand prize per week for a total of 12 weeks with the winner being awarded a Hotel Stay Voucher (HSV), for a location as stated on the price. NO CASH VALUE. Each prize will at the end of the week.

  1. a. ADDITIONAL PRIZE(s)

Each additional entry will be eligible to receive one Hotel Savings Certificate (HSC) gift card of up to a $100, of no cash value.

  1. ODDS OF WINNING

The odds of being selected depend upon the total number of eligible Applications received to The Sweepstakes. The drawing will be conducted and shall be deemed final and binding in all respects.

The Sweepstakes is subject to all applicable federal, provincial, municipal and local laws, and is void where prohibited or restricted by law. No correspondence will be entered into except with selected entrant(s) who will be notified by mail and/or telephone. By entering The Sweepstakes, each winner of any prize is deemed to allow digital correspondence and to allow the publication of their information in any way, shape, and/or form to the public.

  1. RESTRICTIONS

By entering or accepting The Sweepstakes, the winner(s) and potential winner(s) accepts all the conditions, restrictions; requirements and/or regulations required by the Sponsors’ and its affiliates, in connection with the prizes and also agree to accept delivery of the prize based on availability. By entering or accepting a prize, the winner agrees to be bound by the decisions of the judges and these Official Rules and Regulations and to comply with all applicable, provincial and local laws and regulations. In addition, the winner agrees to allow the Sponsors’ including and not limited to other Third Parties, to use the winner(s) name and/or photograph in future advertising materials with no other fees to be paid to the winner for this usage, other than the prize(s) already received.

The sponsor reserves the right to disqualify anyone for fraud, threat, illegalities, unsatisfactory arrangement, misrepresentation, or any reason whatsoever, unfavourable to itself, the public, or other.

Each Participant acknowledges and agrees that the decisions of Sponsor and/or any affiliate(s), shall be final, binding and conclusive in all matters relating to The Sweepstakes. Any person attempting to forge Prize Claim Documents or to defraud Sponsor in any way in connection with The Sweepstakes maybe prosecuted to the fullest extent permitted under the law. In the event of a dispute concerning the identity of an entry, the registered email address associated with the dispute will be deemed the official part of the entry. The prize winner may be required to show proof of being the registered account holder.

Maximum one Prize per household.

  1. LIMITATIONS OF LIABILITY

Sponsors and those working on their behalf will not be responsible for an entry that are lost, delayed, damaged or misdirected or illegible. Sponsors assume no responsibility for lost, stolen, delayed, damaged or misdirected Application(s) or for any failure of the website during the promotional period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any e-mail or Application(s) to be received by Sponsors on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including any injury or damage to an entry or any other person’s computer related to or resulting from playing or downloading any material in the promotion.

The Grand Prize winner and potential winner(s) agree to release and hold harmless Sponsors, third parties, their respective parents, affiliates and subsidiaries, and each of their directors, officers, employees, agents, successors and assigns, from any damage, injury, death, loss or other liability that may arise from winner’s participation in The Sweepstakes or the awarding, acceptance, use or misuse of any prize.

Sponsor reserves the right, at its sole discretion, to substitute a prize of greater or equivalent monetary value if a Prize cannot be awarded as described for any reason. Sponsor will not replace any lost or stolen Prize, HSV, and/or HSC to terms and conditions. If so, any taxes, costs or expenses associated with the Prizes not specified herein will be the responsibility of the selected winners.

Sponsor reserves the right, to terminate, suspend or modify this Sweepstakes, and reject any application in whole or in part, at any time and without notice or obligation if, in Sponsor’s sole discretion, any factor interferes with its proper conduct as contemplated by these official The Sweepstakes rules. Including and not limited to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, programming errors, technical failures, and any other reason whatsoever.

No correspondence will be entered into except with the selected winning applicant who will be notified by mail and/or telephone.

  1. ACCEPTANCE

By entering The Sweepstakes or accepting a prize, the winner(s) and potential winner(s) consent to the use of their name and/or photograph in any publicity carried out by Sponsors in connection with this and/or similar promotions, without compensation, unless otherwise prohibited by law. Applicant(s) are subject to verification and will be declared invalid if they are altered or tampered with in any way.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SPONSOR MAKES NO WARRANTIES OR CONDITIONS AND HEREBY DISCLAIMS ANY AND ALL WARRANTIES OR CONDITIONS, EXPRESSED OR IMPLIED, CONCERNING THE PRIZE. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, SUCH PRIZE IS PROVIDED “AS IS” WITHOUT WARRANTY OR CONDITIONS OF ANY KIND, EITHER EXPRESSED OR IMPLIED, AND, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, The Sweepstakes HEREBY DISCLAIMS ALL SUCH WARRANTIES AND CONDITIONS, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANT ABILITY, FITNESS FOR A PARTICULAR PURPOSE AND/OR NON-INFRINGEMENT.

  1. MISCELLANEOUS

A. General: It is each Participant’s responsibility to ensure that he/she has complied in full with all of the conditions and requirements contained in The Sweepstakes Official Rules. B. Force Majeure/Printing and Production Errors or Omissions: Subject to any governmental approval that may be required, the Sponsor reserves the right, without prior notice and at any time, to terminate The Sweepstakes, in whole or in part, or to modify, suspend or extend The Sweepstakes, if it determines, in its sole discretion, that The Sweepstakes in any way and for any reason is impaired or corrupted or that fraud or technical problems, failures or malfunctions (including, without limitation, computer viruses, computer system overload or any other kind of electronic or other overload, glitches or printing or production errors or omissions) have destroyed or severely undermined the proper play, draw, or other in integrity and/or feasibility of The Sweepstakes. In the event that, in the Sponsor’s sole opinion, the Sponsor is impeded or prevented from continuing with The Sweepstakes planned or intended by any event beyond its control, including, but not limited to fire, flood, natural or manmade epidemic or crisis, earthquake, explosion, labour dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), any federal, provincial, territorial or local government law, order or regulation, public health crisis, the order of any court or jurisdiction, or by any other cause not reasonably within the Sponsor’s control, then subject to any governmental approval which may be required, the Sponsor shall have the right to modify, suspend, extend or terminate The Sweepstakes. C. Invalidity: The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, The Sweepstakes Official Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Headings and captions are used in The Sweepstakes Official Rules and are solely for ease of reference and shall not be deemed or considered to affect in any manner the meaning or intent of The Sweepstakes Official Rules or any provision hereof. The Sweepstakes Official Rules cannot be modified or amended in any way except in writing by a duly authorized representative of the Sponsor. Subject to the provisions of these Official Rules, employees of the Sponsor, or of any of its franchisees, are not authorized to modify, amend or waive these Official Rules. D. Governing Law: All issues and questions concerning the construction, validity, interpretation, and enforceability of The Sweepstakes Official Rules or the rights and obligations as between one or more Participants and the Sponsor in connection with The Sweepstakes shall be governed by and construed and interpreted in accordance with the laws in effect in the Alberta, Canada jurisdiction. All Participants, the Sponsor, and all other parties hereby attorn to the jurisdiction of the courts of Calgary, Alberta, Canada in respect of the determination of any matter or dispute arising under or in respect of The Sweepstakes or The Sweepstakes Official Rules and agree that any such determination shall be brought solely and exclusively before such courts. E. Language or Other Discrepancy: In the event that there is a discrepancy or inconsistency between the English-language version and any interpretation of any other language The Sweepstakes Official Rules or of any Declaration and Release(s), the English language shall prevail, govern and control. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any The Sweepstakes Materials or in the Declaration and Release, or in advertising or other publicity or materials or communications concerning or related to  The Sweepstakes, and the provisions contained in The Sweepstakes Official Rules, the provisions in The Sweepstakes Official Rules shall prevail, govern and control. Privacy: Sponsor will collect, use, and disclose information, including personal information, provided by Participants in connection with  The Sweepstakes for the purposes of administering The Sweepstakes and fulfilling the Prize. Participants may be offered the opportunity to receive additional communications from the Sponsor about its products, and upcoming contests and promotions.  The Sweepstakes may be hosted on servers in various locations, and the personal information provided by Participants may therefore also be subject to the laws of these jurisdictions not limited to and including the United States and/or others. Except as otherwise contemplated in The Sweepstakes Official Rules, personal information collected, used, and disclosed by the Sponsor in connection with The Sweepstakes will be dealt with by the Sponsor in accordance with the Sponsor’s online privacy policy posted at https://adiamondmortgage.com/privacy-policy/. G. Cooperation in Prize Award Event(s): In consideration of being awarded the Prize in The Sweepstakes, the Prize winner cannot be a minor. H. The Sweepstakes Official Rules Availability: These Official Rules will be available at The aDiamondMortgage.com website. To receive a copy of the Official Rules via mail, a Participant should mail, in a postage-paid outer envelope, a self-addressed, postage-paid inner envelope to the Sponsor’s address listed above with one (1) self-addressed, postage-paid envelope per outer envelope.
